    • "Customer/User" refers to any individual, entity, or organization using our services.
    • "Services" refer to bulk SMS services, including transactional, promotional, and OTP messages.
    • "Content" refers to any text, message, or data sent via our platform.
  1. ELIGIBILITY

  2. By using our services, you represent that you:
    a) Are at least 18 years old.
    b) Have the legal authority to enter into a binding agreement.
    c) Will use the services in compliance with applicable laws and regulations.

  1. SERVICE USAGE POLICY
    • The customer must not use our services for spamming, fraud, misleading advertising, or any illegal activity.
    • All SMS content must comply with the rules and regulations of the Telecom Regulatory Authority of India (TRAI) or any other applicable regulatory body.
    • Promotional messages shall only be sent to users who have opted-in to receive them.
    • The company reserves the right to suspend or terminate accounts that violate these policies.
  1. MESSAGE DELIVERY & LIMITATIONS
    • While we strive for maximum delivery success, we do not guarantee 100% message delivery due to factors beyond our control (e.g., carrier issues, recipient phone availability).
    • The customer acknowledges that some messages may be delayed or undelivered due to technical reasons.
  1. PRICING & PAYMENTS
    • Our pricing is as per the chosen plan and is subject to change with prior notice.
    • Payments are prepaid unless otherwise agreed in writing.
    • No refunds will be provided for services already used.
  1. CONTENT RESPONSIBILITY
    • Customers are solely responsible for the content of their messages.
    • The company is not liable for any damages arising from content that is false, misleading, offensive, or illegal.
  1. DATA PRIVACY & SECURITY
    • We follow strict data security measures to protect user data.
    • Customer data will not be shared, sold, or disclosed to third parties without consent, except as required by law.
  1. ACCOUNT TERMINATION

  2. We may terminate or suspend accounts in cases of:

    • Violation of these Terms of Service.
    • Non-payment of dues.
    • Any activity that may harm our platform or reputation.
  1. LIMITATION OF LIABILITY
    • The company is not liable for any losses, damages, or claims arising from service interruptions, delivery failures, or third-party actions.
    • Our total liability is limited to the amount paid by the customer for the services in the last 30 days.
  1. FORCE MAJEURE

  2. We shall not be liable for any delay or failure in performance due to reasons beyond our control, including natural disasters, technical failures, regulatory changes, or telecom network failures.

  1. MODIFICATION OF TERMS

  2. We reserve the right to update or modify these Terms of Service at any time. Continued use of the service after modifications implies acceptance of the new terms.

  1. GOVERNING LAW & DISPUTE RESOLUTION

  2. These terms are governed by the laws of India. Any disputes shall be resolved through arbitration in [City, State], as per the Arbitration and Conciliation Act, 1996.
